1. INTRODUCTION
These terms of sale govern the agreement between Beyoga OE, located at Calle Poeta Campos Vasallo N38, Bajo, Alicante 03004, and the customer, established through the website www.wearebeyoga.com for the purchase of Beyoga products by the customer via the Website.

Beyoga provides its customers with an online service to book yoga classes through a monthly subscription model or specific individual classes.

Below, we invite you to review the general terms and conditions of purchase that govern the acquisition of Beyoga products through the website www.wearebeyoga.com, owned and managed by Beyoga.

In this regard, using the Website implies, where applicable, your acceptance of these general terms of purchase.

2.- CONTRACT

2.1. Service Availability

The pages of this website are publicly accessible, free of charge.

You must use the website in compliance with the Law, good customs, morality, and public order.

Therefore, the owner of this website assumes no liability arising from misuse, improper use, incorrect, or unlawful use of the website and/or its content.

Accessing the website www.wearebeyoga.com does not imply the establishment of any commercial relationship between Beyoga and you.

By placing an order through this website, you declare that you are over 14 years old.

Minors under 14 cannot independently consent to an online business collecting and processing their personal data. Consequently, they cannot formalize online purchase agreements; instead, their legal representatives (parents or guardians) must do so on their behalf.

2.2. Product Guarantee

According to Article 114 of RDL 1/2007 regarding the General Law for the Protection of Consumers and Users:

The items offered on this website are a selection of products from the CATEGORIES collection and meet the same quality and guarantee standards as the products sold at Beyoga's physical store.

Each product includes the following details:

  • Product name

  • Product description

Beyoga has made an effort to describe the products as accurately as possible. However, the products displayed on the screen may be subject to variations depending on the availability or quality of the instructor.

The legal guarantee for all our products complies with the law and will always be respected by Beyoga. This guarantee is regulated by the General Law for the Protection of Consumers and Users, which establishes a minimum guarantee period of 2 years for any new product.

According to Article 114 of RDL 1/2007: The seller is obligated to deliver products to the consumer and user that comply with the contract, being liable for any non-conformity existing at the time of delivery.

If the product under guarantee does not meet optimal conditions for use, Beyoga will assume the corresponding responsibility by refunding the amounts paid for the product and reimbursing any costs incurred by the customer to acquire or return the product, provided proof of purchase is presented (e.g., return slip or purchase invoice).

If the product has any defect, you may return it to our center or send it back by mail.

Once the defect is verified, we will refund the full amount paid.

2.3. Pricing

Beyoga strives to describe the products as realistically as possible. However, the items shown on the screen may vary depending on the quality or availability of the instructor.

The legal guarantee for all our products complies with the law and will always be respected by Beyoga.

If there is an error in a product, you may return it to our center or send it by mail.

2.4. Purchase Procedure

You can make purchases by creating a customer account in the “New Account” section, filling in all required information, or downloading our Beyoga app.

The personal data you provide will be processed according to our Privacy Policy.

Once you’ve selected your favorite items and added them to your cart, click on it to proceed with the order. The cart will show the product name, price (including taxes), and options to modify or remove items.

Discount codes or promotional codes can be applied before finalizing the purchase.

2.5. Order Cancellation

To cancel an order after it has been completed and paid for, contact our Customer Service team at info@wearebeyoga.com.

2.6. Product Availability

All orders are subject to product availability.

2.7. Purchase Limits

If your order cannot be fulfilled, we will contact you to discuss alternative solutions, such as splitting the order into separate shipments.

2.8. Order Acceptance

All orders are subject to our acceptance.

No contract will exist between us for any product until we have explicitly accepted your order. If your purchase request is not accepted, the order amount will be fully refunded.

Reasons for not accepting an order may include:

  • Technical or typographical errors in product pricing or details.

  • Lack of availability as described in section 2.6.

  • Fraudulent activity flagged by our security systems.

  • The customer being under 18 years old.

  • Cyberattacks, viruses, or events beyond Beyoga’s reasonable control (force majeure).

Beyoga will inform you of the non-acceptance of your order and refund any amounts paid.

Your purchase confirmation will be sent within 24 hours after placing the order.

 

3.- PAYMENT

Prices on the Website and app are displayed in Euros.

Product prices may change at any time, but such changes will not affect orders for which Beyoga has already sent a Confirmation of Order.

3.1 Value Added Tax
All product prices listed on this Website include VAT at the prevailing rate at any given time.

3.2 Invoicing
You expressly consent to receive the invoice in electronic format.

The invoice generated by the system will be sent to you via email along with the shipping confirmation for the order. It will be a simplified invoice with the details provided in your Billing Address.

3.3 Payment Methods
Beyoga only accepts payments made via credit or debit cards.

The order will not be generated until the payment is completed, so payment is required to receive the Order Confirmation.

3.4 Payment with Credit or Debit Card
Beyoga accepts payments made on the Website/App using the following credit or debit cards: Visa and Mastercard.

Charges are processed online in real-time through the corresponding financial institution's payment gateway after verifying that the provided information is correct.

3.5 Payment Security
To ensure maximum security in the payment process, Beyoga uses secure payment systems from leading financial institutions in e-commerce.

Confidential payment information is transmitted directly and securely (SSL encryption) to the corresponding financial institution. For Visa and MasterCard payments, Beyoga only accepts CES (Secure Electronic Commerce) transactions, which may include the international 3D Secure protocol identified by the Verified by Visa and MasterCard SecureCode logos.

Secure Electronic Commerce ensures safe online transactions. During the payment process, the system will automatically verify that the credit card is activated for Secure Electronic Commerce. The system will then connect to the issuing bank, which will request authorization for the operation using a personal authentication code. The transaction will only proceed if the issuing bank confirms the authentication code. Otherwise, the transaction will be rejected.

As an additional measure to the 'Secure Payment' system and to help prevent online fraud, Beyoga reserves the right to verify the personal details provided by the customer and take appropriate measures (including order cancellation) to ensure the purchased merchandise is delivered in accordance with the order details.

4. RETURNS AND EXCHANGE POLICY

4.1 Terms for Returns and Exchanges
At Beyoga, we strive to ensure your satisfaction. If for any reason you are not happy with your purchase, you can exchange the product within 2 days from the date of purchase, provided that the product has not been used. Please note, we cannot accept returns or exchanges for used items.

To process a return or exchange, please send an email to info@wearebeyoga.com with the following information:

  • Full purchase details

  • Reason for the return

  • Your personal information

If the purchase was made through our website or app using a credit card, the refund will be processed, but it may take 5 to 10 business days to appear in your bank account.

5. RIGHT TO MODIFY THESE TERMS AND CONDITIONS

Beyoga reserves the right to review and modify these Terms and Conditions at any time.

However, the price and other conditions of the products you have requested will not be altered during the period between your order and the acceptance of the same, as confirmed by the order confirmation.

Should we be required by law or government authorities to implement retroactive changes to these policies, Terms, or Privacy Policy, such changes will also apply to purchases made previously.

7. APPLICABLE LAW AND JURISDICTION

The use of our website or app, and the purchase contracts for products through said website or app, will be governed by Spanish law.

Any dispute, litigation, or disagreement that may arise between you and Beyoga regarding the use of this website or app will be submitted to the Courts and Tribunals that are competent according to the applicable legislation.

Furthermore, under Regulation (EU) 524/2013 of the European Parliament and Council, dated May 21, 2013, which facilitates the resolution of conflicts arising from online commerce between businesses and consumers, Article 13 of the Regulation states: "Member States shall ensure that traders established in their territories inform consumers about the alternative dispute resolution entity or entities covering such traders."

To this end, the ONLINE DISPUTE RESOLUTION body has been established to act as a neutral party and valid interlocutor between both parties, aiming to avoid resorting to judicial courts as much as possible.
